AKKI'S Photography

Please read these Terms and Conditions carefully before booking our services. By engaging AKKI'S Photography, you acknowledge that you have read, understood, and agree to be bound by these terms.

1. Definitions

1.1 "Photographer," "Videographer," "we," "us," and "our" refer to AKKI'S Photography.

1.2 "Client," "you," and "your" refer to the individual or organization hiring AKKI'S Photography for photography or videography services.

1.3 "Media" or "Deliverables" refers to all digital and physical photographs, videos, and related content captured and produced by AKKI'S Photography.

1.4 "Event" refers to the scheduled date and time for which photography or videography services have been booked.

2. Booking, Payments, and Refunds

2.1 Booking Confirmation

  • A 50% non-refundable and non-transferable booking retainer is required to secure your date.
  • Accepted payment method: Zelle
  • Your booking is not confirmed or the date reserved until this payment is received and cleared.

2.2 Final Payment & Late Fees

  • The remaining 50% balance is due on or before the Event date.
  • Late Fee Policy: A grace period of forty-eight (48) hours following the Event is provided for final payments to clear. If the payment is not cleared after 48 hours of the Event, a late fee of $25.00 per day will automatically be applied to the outstanding balance until the invoice is paid in full.
  • Additional hours or services requested beyond the original agreement will be charged at the agreed-upon hourly rate and added to the final invoice.

2.3 Cancellation Policy

  • All cancellations must be submitted in writing.
  • The 50% booking retainer is non-refundable under all circumstances.
  • In addition to the forfeiture of the booking retainer, a $250 cancellation fee applies to all cancellations.
  • No refunds are provided after the Event has taken place.

2.4 Equipment Failure Refund

  • In the rare event that all media is completely lost or damaged due to equipment malfunction beyond our control, and no deliverables can be produced, you will receive a full refund.
  • This applies only when total loss occurs through no fault of either party.

3. Coverage and Team

3.1 Photography/Videography Team

  • At a minimum, one lead photographer or videographer will attend your Event.
  • Additional team members (assistants, second shooters) may be included depending on your selected package.

3.2 Social Media Coverage

  • Our team may capture content using mobile devices for real-time social media promotion and behind-the-scenes coverage.
  • If you prefer not to be featured on social media, please notify us in writing before your Event.

4. Media Delivery and Storage

4.1 Delivery Method

  • All media will be delivered digitally via secure cloud services (Google Drive or similar platforms).
  • You will receive a secure link to access and download your media.

4.2 Delivery Timeline

  • Standard delivery time is 2 to 4 weeks from the Event date.
  • Rush delivery may be available for an additional fee upon request.

4.3 Client Responsibility for Storage

  • You are solely responsible for downloading, backing up, and securely storing all delivered media.
  • We strongly recommend downloading your files immediately to a computer and creating multiple backups (e.g., external hard drive, personal cloud storage).

4.4 Media Retention and Deletion Policy

  • Your delivery link will remain active for 4 weeks from the date of delivery.
  • Due to high storage limitations, AKKI'S Photography permanently deletes client media 4 weeks after initial delivery.
  • Important: We cannot guarantee media availability beyond this period. Failure to download within the specified timeframe is the Client's responsibility.

4.5 Re-Upload, Storage, and Backup Fees

  • If you fail to download your media before the gallery expires and request a re-upload, a $50 storage and backup fee will apply.
  • Re-uploads are only possible if the media is still recoverable (typically within the 4-6 week window). We do not guarantee media availability after the initial delivery period.

5. Photography and Videography Style

5.1 Coverage Style

  • Our default approach is candid, documentary-style coverage that captures authentic moments.
  • If you prefer a different style (e.g., posed or traditional), please specify it in writing before your Event.

5.2 Shot Lists and Requests

  • Specific photo or video requests are welcome and should be communicated clearly in advance.
  • While we will make every reasonable effort to accommodate requests, we cannot guarantee every requested shot due to time constraints, lighting conditions, or other factors beyond our control.

5.3 Creative License

  • AKKI'S Photography retains full artistic license regarding composition, content selection, editing style, and final media delivered.
  • Our goal is to deliver media that reflects our professional standards and artistic vision.

6. Post-Production and Editing

6.1 Standard Editing (Included)

  • All delivered photographs receive professional standard editing at no additional cost, which includes:
  • Color correction and color grading
  • Exposure and contrast adjustments
  • Cropping and straightening
  • Minor distraction removal (e.g., stray objects in the background) strictly at the Photographer's discretion.

6.2 Advanced Editing (Not Included)

  • Standard packages do not include advanced photo manipulation or retouching, such as:
  • Skin smoothing, reshaping, or blemish removal
  • Body shape alterations
  • Hair adjustments or flyaway removal
  • Outfit modifications or "fixes."
  • Complex object removal (items close to or touching the subject)
  • Background replacements or major compositional changes

6.3 Specialized Editing Services

  • Advanced editing requires a specialist editor and is available for an additional fee. If you require this level of work, please inquire for a custom quote. Requests must be made within the complaint period (see Section 10).

6.4 Revision Requests

  • Minor adjustments to delivered media may be accommodated at our discretion.
  • Additional editing beyond the agreed-upon scope will incur extra charges.

6.5 Client Input Deadline and Late Editing Fees All necessary client input, including but not limited to photo selections, song choices, or specific editing instructions, must be provided to the Photographer within sixty (60) days (2 months) of the Event date.

Note: If the required information is not provided within this timeframe, the standard editing included in the original package will be considered forfeited. To initiate post-production after this 60-day period, the Client will be required to pay an "Archive Retrieval and Late Editing Fee" of $150 or the current hourly editing rate, whichever is higher, before any work commences.


7. Copyright and Usage Rights

7.1 Copyright Ownership

  • AKKI'S Photography retains full copyright and ownership of all original images and videos.
  • You may not sell, transfer, or license the media to third parties for commercial use without written permission.

7.2 Client Usage Rights

  • You are granted a non-exclusive license to:
  • Share media on personal social media accounts.
  • Print media for personal use.
  • Share with friends and family for non-commercial purposes.

7.3 Commercial Use

  • Any commercial use of the media requires prior written authorization from AKKI'S Photography and may involve additional licensing fees.

7.4 Promotional Use

  • AKKI'S Photography reserves the right to use images and videos for promotional purposes, including but not limited to our website, social media, marketing materials, and portfolios.
  • If you prefer your media not be used for promotional purposes, please notify us in writing before your Event.

8. Liability and Indemnification

8.1 Limitation of Liability

  • AKKI'S Photography's total liability for any claims arising from services rendered is strictly limited to the total amount paid for services.
  • We are not liable for indirect, incidental, or consequential damages.

8.2 Equipment and Data Loss

  • While we use professional equipment and maintain backups, we are not liable for loss or damage of files beyond the refund specified in Section 2.4.

8.3 Third-Party Interference

  • We are not liable for missed shots or coverage gaps caused by venue restrictions, uncooperative guests, schedule delays, weather, or other circumstances beyond our control.

8.4 Client Indemnification

  • You agree to indemnify and hold harmless AKKI'S Photography against all claims, damages, or expenses arising from services performed under this agreement.

9. Postponements and Rescheduling

9.1 Client-Initiated Postponement

  • If you need to postpone your Event, the original booking retainer will be retained and applied to the new date.
  • A new date must be agreed upon within six (6) months of the original Event date.
  • Postponements are strictly subject to our availability.

9.2 Photographer-Initiated Cancellation

  • In the unlikely event we must cancel due to illness, emergency, or circumstances beyond our control, we will make every effort to provide a qualified substitute photographer/videographer.
  • If a suitable replacement cannot be found, you will receive a full refund of all payments made.

9.3 Weather-Related Postponements and On-Site Cancellations

  • In the event that a session must be cancelled or postponed due to inclement weather after the Photographer has already arrived at the Event location, your previously paid amounts will be converted into a booking credit.
  • This credit is valid for rescheduling a new session within six (6) months of the original Event date.
  • If a new date is not agreed upon and completed within this six-month timeframe, any remaining credit balance will be permanently forfeited.
  • As a courtesy for the disruption, you may be eligible to receive a discount toward a future session, which will be offered at our sole discretion.

10. Complaints and Dispute Resolution

10.1 Complaint Period

Any complaints regarding the quality or content of delivered media must be submitted in writing within five (5) business days of receiving the final deliverables.

Claims made after this period will not be considered.

10.2 Resolution Process

We will review all valid complaints and work with you in good faith to reach a reasonable resolution.

Resolutions may include minor edits at our sole discretion.

11. Travel and Expenses

11.1 Service Area

Our standard service area is Greater Austin, Texas.

Events outside this area will incur additional travel fees.

11.2 Travel Costs

Travel expenses (mileage, fuel, tolls) beyond Greater Austin will be the Client's responsibility unless otherwise agreed in writing. Rates will be specified in your service agreement.

11.3 Accommodations

For events requiring overnight stays or extensive travel, the Client agrees to prepay or provide reasonable accommodations and meals.

These arrangements must be confirmed at least fourteen (14) days before the Event.

12. Independent Contractor Status

AKKI'S Photography operates as an independent contractor. Nothing in this agreement creates an employment relationship, partnership, or joint venture between the parties.

13. General Provisions

13.1 Entire Agreement

These Terms and Conditions, along with your signed service agreement and invoice, constitute the entire agreement between the parties.

13.2 Modifications

Any modifications to these terms must be made in writing and signed by both parties.

13.3 Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full effect.

13.4 Governing Law

This agreement is governed by the laws of the State of Texas.

13.5 Force Majeure

Neither party shall be liable for failure to perform due to circumstances beyond reasonable control, including but not limited to acts of God, natural disasters, pandemics, or government restrictions.
